I am often asked to suggest a lump sum. And sometimes this may be possible. If not, we will agree on an hourly rate and on joint monitoring in order to exclude possible conflicts from the outset.

And one more thing is important to me. We all know the Pareto principle. Very often 80% of the results can be achieved with 20% of the possible total effort. The last 20% accuracy costs are disproportionately higher. This also applies to legal advice and in many cases causes resentment afterwards: about the amount of the fees, the number of contractual points, or the length of an expert opinion. “Less would have been more” is what many think. They were expecting a contract that compactly and clearly covered the likely course of events, but not every contingency. Or a brief that concisely contains the most compelling arguments, but looses sight of what is essential. That’s why we will discuss right at the beginning how much imprecision we are willing to tolerate in order to achieve our goal quickly and at lower cost. After 40 years in the profession, I have now gained the freedom and agility to contribute to a successful attorney-client relationship with a “reduce to the max” approach. I am aware that ultimately you will have to summon up the courage to leave a gap. It is up to me to propose this approach.
